Divorce

Divorce, Dissolution, and Separation

In divorce and separation cases, our solicitors will always make every effort to resolve matters and avoid court proceedings and the associated expenses. However, should court action be required, we are experienced, competent, and knowledgeable litigators and we will be with you every step of the way.

Ideally, separation matters will be resolved by parties entering into a Separation Agreement, also known as a Minute of Agreement. We will advise you in all financial matters pertaining to your separation, including matrimonial assets such as business interests and pensions. Whether your case is contentious or non-contentious, we’re here to help.

With extensive experience and expertise, we can also discuss options such as mediation, to help you resolve matters, and recommend appropriately qualified experts in these areas. Our services also cover civil partnership separations and dissolutions.

Dispute

Contact and Residence (Advice/Disputes/Court Orders)

For matters involving contact with and residence of children, our experienced team will be happy to assist.

Adoption and Permanence Orders

We often work with clients whose children are in the care of the Local Authority, and if a decision is made to pursue permanence or adoption in respect of your child, we provide advice and support to help you challenge and oppose this.

Similarly, we frequently represent individuals who are seeking to adopt children who were formerly in a Local Authority placement. Understanding that these cases are both important and sensitive, we have the right experience to meet your needs.

Private Adoption

Additionally, if you are a separated parent who would like your partner to adopt their child, or if you are thinking about adopting your step-child, we are here to answer any questions you may have. If you decide this is a step you wish to take, we can further assist you throughout the adoption process.

Parental Rights and Responsibilities

If you require advice about your Parental Rights and Responsibilities, we can explain to you what rights you have and what your responsibilities entail. Furthermore, we can assist with the granting or removal of Parental Rights and Responsibilities and also any dispute arising in the discharge of these rights.

Prenuptial Agreements

A prenuptial agreement is entered into prior to marriage as a means of protecting pre-marriage assets. This agreement sets out ownership of your assets and explains how they will be divided in the event of divorce or separation.

Postnuptial Agreements

A postnuptial agreement is a valid contract between spouses, regulating the parties’ assets in the event of a separation. Subject to this being properly drafted and executed, this agreement is binding upon the parties.

Relocation and/or School Placement Disputes

If a parent wishes to move to a new location and the other parent does not agree to this, we help to resolve matters without recourse to the court. If this fails and a court decision is required to resolve the matter, we also have considerable experience in representing clients at court.

We provide similar assistance in school placement disputes, where a parent wishes to move a child to a particular school and the other parent does not agree.
